Just after Darcey's Father was awarded with Shared Parenting by the Australian Family Court, he threw his five year old daughters body over Melbourne's West Gate Bridge.
Former Chief Justice Nicholson made a statement to the ABC program,The World Today, "The law relating to disclosure of Family Court proceedings and identification of parties is breached quite often and I know that myself and my colleagues in the Family Court actually got sick of referring matters for breaches of that sort to the Attorney-General, the DPP and other authorities because nothing ever happened and I think that has really invited the media to behave in this way."
Darcey's uncle stated,"For the past two years the various authorities have been made aware of our fear for the safety of the children and unfortunately no one would listen". "We feel the judicial system has failed our family and will continue to fail other families until someone in authority starts to take action."
Chief Justice Diana Bryant stated, "The parties did not present to the judicial officer concerned as part of their case that this child was at risk of harm in the father's care".
Two days after this was reported, the documents to Darcey's case were allegedly stolen from the Chief Justice Diana Bryant's Car. The transcript to the case was one of the documents that "disappeared". There was no signs of forced entry and no security cameras. The transcript of the case would have contained whether or not the family had raised it concerns and for a case to have extended over a timeframe of two years, the family would have to have been contesting visitations for a good reason as the time and costs of litigating for such a period are exhaustive.
During this period, mothers and children who experienced similar circumstances began speaking out on forums and online journals about the negligence towards their own lives. This was very dangerous for the Family Court as it meant that these groups could form and instigate class action law suits for the complete disregard of theirs and their children's lives
